Adderley Recruitment Group Limited (ARG) is a recruitment business which provides work-finding services to its clients and work-seekers. The Company must process personal data (including sensitive personal data) so that it can provide these services – in doing so, we act as a data controller.

You may give your personal details to the Company directly, such as on an application or registration form or via our website, or we may collect them from another source such as a jobs board.

The organisation is committed to being transparent about how it collects and uses that data and to meet our data protection obligations.

Data Protection Principles 

The Company will comply with data protection law. This means that the personal information we hold about you must be:

  • Collected only for valid purposes that we have explained to you clearly and not used in any way that is incompatible with these purposes;

  • Accurate and kept up to date;

  • Kept only for such time as necessary for the purposes we have told you about; and

  • Kept securely.

What sort of data do we collect?

  • your name, address and contact details, including email address and telephone number;

  • details of your qualifications, skills, experience and employment history, including start and end dates, with previous employers and with the Company;

  • information about your current level of remuneration, including benefit entitlements;

  • whether or not you have a disability for which the organisation needs to make reasonable adjustments during the recruitment process; and

  • Information about your entitlement to work in the country.

We also collect information in the aggregate to provide us with a better understanding of the Users of our Website as a group, their browsing patterns and preferences. This Aggregate Data does not contain personally identifiable information.

Why do we process this personal data?

The Company will collect your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with work-finding services. This includes for example, contacting you about job opportunities, assessing your suitability for those opportunities, updating our databases, putting you forward for job opportunities, arranging payments to you and developing and managing our services and relationship with you and our clients.

In some cases, we need to process data to ensure that we are complying with its legal obligations. For example, it is mandatory to check a successful applicant's eligibility to work in the UK before employment starts. We may also need to process data from job applicants to respond to and defend against legal claims.

If your application is unsuccessful, we will keep your personal data on file in case there are future employment opportunities for which you may be suited. If you do not wish for your data to be retained then you have the right to remove your account and all associated data.

How long does Adderley Recruitment Group Limited (ARG) Limited keep data for?

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services. In line with this we will keep your data for a maximum of 3 years. Upon expiry of that period the Company will seek further consent from you. Where consent is not granted the Company will cease to process your data and it will permanently be deleted.

Who Has Access to Data? 

The Company shares your data with third parties where required by law or as part of work-finding services, where it is necessary in order to administer the working relationship with you or where we have another legitimate interest in doing so. The Company may also share your data with other third parties, for example, in the context of a sale of some or all of its business. In those circumstances the data will be subject to confidentiality arrangements.

How Does The Company Protect Data? 

The Company takes the security of your data seriously. The Company has internal policies and controls in place to prevent your data being lost, accidentally destroyed, misused or disclosed, and is not accessed except by its employees in the performance of their duties. When the Company engages third parties to process personal data on its behalf, they do so on the basis of written instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of data. Your Rights 

As a data subject, you have a number of rights. You can:

  • Access and obtain a copy of your data on request (known as a “data subject access request”)

  • Require the Company to change incorrect or incomplete data;

  • Request erasure of your personal information. This enables you to ask the Company to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing.

  • Object to the processing of your data where the Company is relying on its legitimate interests as the legal ground for processing; and

  • Ask the Company to suspend the processing of your personal data for a period of time if data is inaccurate or there is a dispute about its accuracy or the reason for processing it.

Terminology

Aggregate Data - this is when all data is collected and processed as a total to enable us to look at such information as demographic and geographic trends, so that we can try to produce a better service in the future. This data is not personally identifiable data.

Data - information which is being processed by equipment operating automatically in response to instructions given for that purpose, is recorded with the intention that it should be processed by means of such equipment, is recorded as part of a relevant filing system or with the intention that it should form part of a relevant filing system or forms part of an accessible record.

Data Protection Act 1998 - this is the act of Parliament which set out principles relating to the use of data to ensure that the rights of the person who is the subject of the data are protected under the law.

Personal data - data which relates to a living individual who can be identified from those data, or from those data and other information which is in the possession of, or is likely to come into the possession of ARG.

Privacy policy - this statement by ARG which explains the ways that we try to protect our Users' privacy.

Recruitment process - the process of gaining employment and recruiting new staff and the ongoing administrative process involved once a user has gained employment or recruited new staff.

Sensitive personal data - personal data consisting of information as to the racial or ethnic origin of the data subject, political opinions, religious beliefs or other beliefs of a similar nature, membership of a trade union, physical or mental health or condition, sexual life, the commission or alleged commission of any offence or any proceedings related to any offence.

Third Parties - these are companies and people other than ARG and the group of companies of which it is part.

Users - people who use our Website and register their details with us for the purposes of recruitment, either to gain employment or for the purposes of recruiting new staff.
